These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and STS Digital Ltd (“us”), concerning your access to and use of the stsdigital.ch website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected there to (collectively, the “Site”).
STS Digital Ltd is licensed by theBermuda Monetary Authority under the Digital Asset Business Act 2018 as a ClassM digital asset business (License No. 202200985). This Site presents our services but does not provide access; clients must register separately withKYC.
Digital assets involve volatility, cybersecurity threats (we maintain insurance), and potential for mistaken transfers (remedies via client agreement). Transfers may be irrevocable. For full details, contact us.
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms andConditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.
The material provided on the Site is provided for information purposes only and does not constitute an offer or solicitation for the purchase of any services or any form of financial instruments.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.
The Site is intended for users who are at least 18 years old.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on theSite (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Switzerland, foreign jurisdictions, and international conventions. Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.
USER REPRESENTATIONS
By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms and Conditions; (2) you will not access the Site through automated or non-human means; (3) you will not use the Site for any illegal or unauthorized purpose; (4) your use of the Site will not violate any applicable law or regulation. PROHIBITED ACTIVITIES You may not access or use the Site for any purpose other than that for which we make the Site available. These Terms and Conditions shall remain in full force and effect while you use the Site. We may terminate or suspend access without notice.

GOVERNING LAW
These Terms and Conditions are governed by and interpreted following the laws of Bermuda, without regard to its conflict of law principles.
DISPUTE RESOLUTION
Any legal action arising out of or relating to these Terms and Conditions shall be instituted in the courts of Bermuda.
CORRECTIONS
There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct them.
DISCLAIMER

LIMITATIONS OF LIABILITY
In no event will we be liable for any indirect or consequential damages.
INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from any claims arising from your use of the Site.

We comply with Bermuda's Personal Information Protection Act 2016 (PIPA). As a DABA Class M licensee, we adhere to client protection standards, including data security.

The Tools collect information such as how often users visit this site, what pages they visit when they do so, and what other site(s) they used prior to coming to ours. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
WHAT ARE YOUR DATA PROTECTION RIGHTS?
Under applicable law, you have rights like accessing your data, correcting it, asking us to delete it, restricting its use, objecting to processing, or requesting a copy to take elsewhere.
- Access:you have a right to get access to the personal data we hold about you. Please submit a request at legal@stsdigital.io.
- Correction:If you believe any of the data we hold about you is inaccurate, you have the right to request that we limit the use of that data and to rectify the inaccurate personal data.
- Erasure:You have a right to request the deletion or removal of your personal data, and subject to the relevant law or regulation, we have to comply with that request in the following circumstances: - we no longer need to use your personal data for the purposes for which it was originally collected; - we have requested your consent to use your personal data and you wish you withdraw that consent ;or - we are not using your information in a lawful manner.
- Limit use: You may request us to restrict the use of your personal data if you believe that: - any of the data we hold about you is inaccurate; - we no longer need to use your data for the purposes for which it was provided, but you require the information to establish, exercise or defend legal claims; or - are not using your data in a lawful manner.
- Portability:where we have requested your consent to use your personal data or you have provided us with data for the purposes of entering into a contract with us, you have a right to receive the personal data you provided to us in a portable format. You may also request us to provide it directly to a third party, if technically feasible. We’re not responsible for any such third party’s use of your personal data, which will be governed by their agreement with you and any privacy statement they provide to you.
- Withdrawal of consent: Where we rely on your consent to process your personal data, you have a right to withdraw that consent at any time. INTERNATIONAL TRANSFERS
We may need to transfer your personal information to overseas third parties—meaning organizations or service providers not based in Bermuda—for purposes like storing data with secure cloud providers or sharing within our group for internal operations. We remain fully responsible for complying with PIPA regarding your information.
Before any transfer, we assess the level of protection that the overseas third party will provide. This includes reviewing the laws that apply to them to see if they offer a comparable level of protection to PIPA. In the event the protection is not comparable, we will put in place measures like contractual agreements or corporate codes of conduct to make sure your information gets the same level of safeguarding as required by PIPA. In some cases, we might still transfer information without these extra steps if it is necessary for defending legal rights or if we determine the transfer is small-scale, occasional, and unlikely to affect your rights.
